Three new tax avoidance schemes are named by HMRC (29 September 2022)

HMRC is continuing to update their list of publicly named tax avoidance schemes. On the 29th of September, HMRC added three new businesses to the list – Focus Contractor Limited, Greenwich Contracts Ltd, and Nicely Paid Limited. Keep reading and find out more information about these three organisations.

Focus Contractor Limited

  • Promotor of Scheme: Focus Contractor Limited (FCL)

  • HMRC’s Scheme Description (summary): “Users enter into an employment contract with FCL which stipulates the employee will work on client assignments and will be paid at least the National Minimum Wage (NMW). Users also enter into an agreement to Grant an Option (the Option Grant Agreement). FCL retains between 15% and 21% of the gross contract value invoiced to the agency or end user for the services carried out by the users. FCL pays the scheme users the remaining balance, via a combination of a NMW salary and an untaxed amount, supposedly made as payment for the grant of an option to users.”

Greenwich Contracts Ltd

They also receive a second payment from IRL. This includes 2 elements: a small ‘bonus’ of around £10 which is paid through the payroll and subject to tax and NICs, and an additional amount which is not taxed and reflects the balance of their gross contract value, minus the fee deducted for operating the scheme.”

Nicely Paid Limited

  • HMRC’s Scheme Description (summary): “Users of the scheme would receive their gross contract value in 2 separate payments. The first element was a salary paid via NPL. This was generally paid at National Minimum Wage (NMW). The second payment was by way of a loan. It did not go through PAYE and was made as a separate payment.”

I hope they continue to publish names of tax avoidance schemes – it’s extremely helpful and is certain to deter criminals.
