The HMRC website states the scheme operates as follows:

  1. Scheme users sign employment agreements with Greenwich Contracts Ltd (GCL) and Integra Resourcing Limited (IRL). The GCL contract states the user will be paid a salary equivalent to the National Minimum Wage (NMW) along with any commission to be paid under the Commission Plan referred to in Schedule 1 of the contract. The IRL contract says they will make advances of a bonus at their discretion.
  2. The scheme users are required to forward timesheets to GCL for their work and GCL invoices the end client. Scheme users are later provided copies of the remittance note from the agency/end user to GCL. This confirms their rate of pay and hours worked.
  3. In accordance with the employment contract:
    • GCL pays the user a NMW salary – this is subject to deduction of tax and National Insurance contributions (NICs)
    • IRL makes a second, composite, payment to the user for a small ‘bonus’ (usually around £10) that is subject to tax and NICs, and a second larger amount that reflects the user’s remaining gross contract value, and this is made without deductions for tax or NICs
